BLOCK EXEMPTION FOR VESSEL SHARING AGREEMENT (VSA) AND VOLUNTARY DISCUSSION AGREEMENT IN RESPECT OF LINER SHIPPING SERVICES

The Malaysia Competition Commission (MyCC) is an independent body to enforce the Competition Act 2010 (hereinafter "CA 2010"). Provision under section 8(1) of the Act, allows MyCC to grant an exemption to a particular category of agreements from the prohibition under section 4 of the Act if the application cumulatively fulfills the four requirements under section 5 of the Act.

BLOCK EXEMPTION

For your information, MyCC granted a two-year block exemption for VSA and VDA in respect of liner shipping services which will expire on 6 July 2019. MyCC upon its assessment on the new application proposes to extend the Block Exemption for Vessel Sharing Agreement (VSA) for another three years and discontinue an extension for Voluntary Discussion Agreement (VDA). The duration for public consultation is 30 days starting from 31 May 2019 and will end on 29 June 2019. The feedback and written submission with regards to the above public consultation shall be made not later than 5 pm on 29 June 2019. Any written submission for the proposed block exemption shall be submitted to [email protected]

In addition, MyCC will organize a Physical Public Consultation Session on the following date and venue to gather feedback from the stakeholder:
