Malaysia Competition Commission (MyCC)

The Competition Act and the Competition Commission Act were gazetted on 10 June 2010 and enforced beginning 1 January 2012. The acts aimed to encourage national economic development by encouraging and protecting the competition process in the market and consequently protecting consumer interests. To supervise provisions included in the Competition Act 2010, the Competition Commission was established under the Competition Commission Act 2010 on 1 April 2011.

Commission’s Main Functions

The Competition Commission Act 2010 empowers the Malaysia Competition Commission (MyCC) to carry out functions such as implement and enforce the provisions of the Competition Act 2010, issue guidelines in relation to the implementation and enforcement of the competition laws, act as advocate for competition matters; carry out general studies in relation to issues connected with competition in the Malaysian economy or particular sectors of the Malaysian economy; inform and educate the public regarding the ways in which competition may benefit consumers in, and the economy of, Malaysia.

Investigation and Enforcement Division

Principal Assistant Director, Grade 48 (1 Position)

Management of Investigation Unit.

  • To manage and supervise inquiries and other related activities leading towards the investigation of cases;
  • To supervise and guide Investigation Officers in obtaining and recording statements from complainants, target enterprises, witnesses and other relevant parties;
  • To be responsible for ensuring the completion of Investigation Papers and Investigation Reports based on facts and evidence gathered during an investigation.
  • To supervise and monitor the collection and preservation of physical/digital evidence obtained during the course of an investigation including via intelligence and surveillance works in accordance with the relevant laws;
  • To have overall supervision of ongoing investigations and to be responsible in informing and answering any queries from the Commission;
  • To manage and supervise the enforcement of any decisions of the Commission including interim measures and undertakings;
  • To support other divisions in the Commission in the oral representation and appeal stages as and when required; and
  • To supervise and coordinate the initiation and investigation of criminal cases under Competition Act 2010.

General Responsibilities

  • To assist the Director in supervising and coordinating the overall functions of the Enforcement Division;
  • To support other units in the Enforcement Division as and when required;
  • To guide and mentor the officers under his/her supervision in the completion of their tasks.
  • To work together in developing the Enforcement Division’s Standard Operating Procedures and Guidelines.
  • To establish and maintain a close working relationship with counterparts from other law enforcement agencies such as the Police, Bank Negara Malaysia Malaysia Anti-Corruption Commission and other ministries/agencies/regulators/ local authorities.
  • To supervise, implement and enforce any other directions, instructions and orders made by the Commission.
  • Advanced university degree (Master’s degree or equivalent) in Law or related area. A first-level university degree in combination with at least two additional years of qualifying experience may be accepted in lieu of the advanced university degree;
  • Min 8 years of experience in investigation and enforcement/criminal litigation/ prosecution;
  • Knowledge and/or experience of investigation and enforcement in Competition Law would be an advantage;
  • Experience and knowledge in using digital forensics software for investigation purposes would be an advantage;
  • Analytical, highly self-motivated, resourceful and able to work independently and in a team setting;
  • Excellent time management skills, highly resilient and able to accommodate tight deadlines;
  • Excellent communication skills, professional attitude and strong integrity;
  • Able to lead a team with multiple capabilities and to work closely with other Division to ensure the effectiveness of the outcome/result
  • Excellent written and spoken skills in English and Bahasa Malaysia.

Strategic planning And International Affairs Division

  • Reports to the Chief Executive Officer and answerable to the Commission Members of the MyCC.
  • The director of strategic planning and international affairs will be directly responsible to plan, formulate, coordinate, execute and monitor the works of the following functions :
    • i. Strategic Planning;
    • ii. Policy advise;
    • iii. International affairs; and
    • iv. Secretariat for meeting.
  • Main responsibilities include:
    • i. Oversee the overall development and progress of the Commission through Strategic Planning;
    • ii. Formulate policies and advices in relation for competition concerns
    • iii. Coordinate international capacity building and technical assistance programmes through ASEAN, OECD, ICN, UNCTAD and EATOP;
    • iv. Coordinate cross-border anti-competition issues; and
    • v. Provide technical expertise on competition policy and law during FTA/WTO/ASEAN/Bilateral/Multilateral negotiations.
  • Degree/Master in Business Management/ Administration/ Economics/ Law/ International Relations/ Public Policy;
  • Minimum 10 years of experience in the related field(s);
  • Sound knowledge on competition policy and law or equivalent;
  • Knowledge on government policies would be an added advantage including experience liaising with Government department and agencies;
  • Analytical, self-motivated, dedicated and able to work independently;
  • Strong communication and interpersonal skills;
  • Great command of Bahasa Malaysia and English.
