The Malaysia Competition Commission (MyCC) has initiated a comprehensive Market Review on the Digital Economy Ecosystem under the Competition Act 2010 [Act 712]. This review, conducted from July 2024 to December 2025, aims to assess and strengthen the competitive landscape of selected subsectors within Malaysia's fast-growing digital economy.
Section 11(1) of the Act 712 empowers MyCC to review any market which to determine whether any feature or a combination of features of the market that may prevent, restrict, or distort competition. Recognising the digital economy's significant role in Malaysia's growth, MyCC is committed to enhancing the sector’s sustainability and effectiveness. The market review will examine key features and interactions within the digital marketplace that could affect competition. The scope of MyCC’s review will encompass:
- Mobile operating and payment system;
- E-commerce (Retail marketplace);
- Digital advertising services;
- Online travel agencies (OTAs); and
- Data privacy & protection (Cross-cutting theme).
This public consultation aims to gather stakeholder feedback, particularly on the proposed targeted and general preliminary recommendations outlined in the Draft Final Report. Scope's Definition
Mobile operating and payment systems
- Mobile OS - Software platforms that manage core functions, interface with hardware, and enable application execution.
- Integrated payment system - Payment mechanisms embedded within mobile applications that use APIs, to enable seamless in-app transactions, for digital goods and services.
E-commerce (Retail Marketplaces)
- Business-to-consumer (B2C) marketplace platforms that enable online transactions between multiple merchants and buyers. These platforms serve as intermediaries, facilitating the sale of goods over the internet.
- Service-related platforms (such as transportation and food delivery) are excluded from this scope.
Digital advertising services
Digital advertising marketplaces and platforms that connect advertisers and publishers, enabling them to trade ad inventory displayed across search engines, social media, and other digital channels.
Online travel agencies (OTA)
Web and mobile-based platforms that allow consumers to book travel services, with focus being only on accommodation booking platforms.
Data privacy and protection
- This study examines two key data-related areas:
- Data privacy - the rights of internet users to control their personal information sharing and usage in the digital marketplace.
- Data protection - the mechanisms and practices companies use to prevent misuse or unauthorised access of personal and sensitive information they collect, store, and process.
- In understanding data privacy & protection across the four sub-sectors, key areas of data usage, transparency, data control and compliance will be studied.
