Market Review on the Digital Economy Ecosystem under the Competition Act 2010

The Market Review on the Digital Economy Ecosystem, conducted under the Competition Act 2010 [Act 712], marks the eighth market review undertaken by Malaysia Competition Commission (MyCC), aimed to review any market in order to determine whether features, or a combination of features, may prevent, restrict, or distort competition. This market review examined key characteristics and interactions within the digital marketplace that could affect competition, and proposed strategic recommendations to relevant regulators to address these challenges:

  1. Mobile operating systems and payment platforms;
  2. E‑commerce (retail marketplaces);
  3. Digital advertising services;
  4. Online travel agencies (OTA); and
  5. Data privacy and protection (cross‑cutting theme).

Through this Market Review, MyCC has identified 34 issues spanning competition, market, and regulatory dimensions. Addressing these challenges will require strategic coordination among relevant regulators. To this end, MyCC has proposed 18 recommendations for consideration, with the aim of positioning this Market Review as a guiding framework for regulators to strengthen existing policies and regulations.
